Terms and Conditions

Welcome to the Terms and Conditions ("Terms") for the EVGA Get 20% Off EVGA XR1 Capture Device Promotion (“Promotion”). These Terms form an agreement between you and EVGA Corporation and/or its affiliates ("EVGA") and govern the respective rights and obligations of each party to the agreement with respect to the Promotion. By participating in the Promotion, you (“you” refers to you or anyone who participates in the Promotion; you may also refer to “participant” or “customer”) also agree to be bound by the EVGA website (“EVGA.com”) Terms of Use Policy, Privacy Policy, Store Terms, and all other policies, conditions, limitations and disclaimers appearing on EVGA.com and incorporated into these Terms.

Overview

This Promotion provides EVGA customers that have purchased an EVGA GeForce^® RTX^™ 30 Series graphics card or power supply with a coupon for 20% off an EVGA XR1 Capture Device at an EVGA Store. The coupon must be used during checkout when purchasing the EVGA XR1 Capture Device.

How To Redeem

Participants must first register or have an active account at EVGA.com. Once logged in, Participant must register their qualifying EVGA GeForce^® RTX^™ 30 Series graphics card or power supply to their account. Once the product is registered, the Participant must visit the Promotion page at https://www.evga.com/articles/01444/evga-xr1-promotion/. On the Promotion page, Participant must agree to the terms and conditions and submit a request for the XR1 Capture Device coupon.

Once requested, Participants will see the coupon code on the Promotion page. Copy the coupon code. Add the EVGA XR1 Capture Device to your shopping cart and proceed to the checkout. Eventually, you will reach a screen that has your order summary and will offer you the opportunity to add a coupon to your order. Add the coupon code and apply the code, and you should see the discount added to your order. Complete checkout and enjoy your brand new EVGA XR1 Capture Device!

Requirements

• The Promotion is open to all eligible participants with a valid and active account at EVGA.com to participate, except where prohibited by law.
• Participant must be located in a region serviced by an EVGA Store, such as EVGA.com, which carries the EVGA XR1 Capture Device.
  • Offer good only at an EVGA Store. Coupon may not be used at a third-party reseller, EVGA’s official Ebay store, or EVGA’s official Amazon Marketplace store.
• The Promotion begins on November 18, 2020, and will be open for a limited time.
  • Once the Promotion expires, customers may no longer request a coupon to purchase an EVGA XR1 at a discounted rate, customers may no longer redeem the coupon to purchase an EVGA XR1 at a discounted rate, nor will EVGA make exceptions for customers that fail to take advantage of the Promotion while it is open.
• This Promotion is available to original owners of an EVGA GeForce^® RTX^™ 30 Series graphics card or power supply.
  • EVGA graphics cards or power supplies purchased as recertified products (-RX) or bulk products (-BX) are expressly excluded from this promotion.
  • Products must be purchased from an authorized reseller, retailer, e-tailer or distributor of EVGA products. Products purchased from unauthorized resellers or dealers, which include, without limitation, secondhand purchases, online marketplaces such as eBay (except for EVGA's official eBay store), Amazon (except for EVGA's official Amazon Marketplace store), and other online auction and/or marketplace websites do not qualify for the Promotion.
  • Products received free through a separate promotion or contest do not qualify for the Promotion.

Additional Terms and Conditions

• EVGA reserves the right to modify, suspend, or cancel the Promotion at any time, for any reason, and without notice.
• One coupon available per person. No exceptions, substitutions or exchanges are permitted.
• Once a participant’s order ships, the Promotion coupon will be deemed “used” and will no longer be useable by participant.
• The Promotion does not currently have an end date, but will not last indefinitely. The Promotion and option to purchase an EVGA XR1 Capture Device at a discounted rate will expire once the Promotion has ended. Any unused coupons will immediately expire and become void at the termination of the Promotion.
• Rain checks are not permitted nor will be provided in the event that an EVGA Store no longer has stock of the EVGA XR1 Capture Device at any point throughout the duration of the promotion. The Promotion is not a guarantee that an EVGA Store will have stock at all times during the Promotion, nor is the Promotion’s coupon a guarantee that Participant will secure an EVGA XR1 Capture Device ahead of a non-participant. As with most products on an EVGA Store, the EVGA XR1 Capture Devices are sold first come, first served regardless of whether the purchaser is a Participant of the Promotion.
• EVGA will not be responsible for any losses or damage suffered by participant due to failure to register for an account, failure to register qualifying products, or failure to complete any or all steps within the time limit of the Promotion.
• The coupon provided through the Promotion does not have a monetary value and cannot be exchanged for cash or EVGA Bucks.

Disclaimer

The Promotion is provided as an opportunity for registered accounts at EVGA.com with registered qualifying products. Registration is available to all EVGA customers and registered accounts at EVGA.com. Participants of this Promotion agree to be bound by the Terms and Conditions in this document. Failure to follow the Terms and Conditions may void the coupon provided through this Promotion. The Promotion will begin on November 18, 2020, and will remain open for a limited time.

EVGA is not responsible for loss or damage caused by a Participant’s failure to follow the registration requirements, or failure to follow the requirements of the Promotion.

EVGA reserves the right to alter and/or terminate the Promotion and its Terms and Conditions in part or in their entirety, without notice or compensation, at any time.

If any provision contained in these Terms is or becomes invalid, illegal, or unenforceable in whole or in part, such invalidity, illegality, or unenforceability shall not affect the remaining provisions and portions in these Terms, and the invalid, illegal, or unenforceable provision shall be deemed modified to have the most similar result that is valid and enforceable.

Offer void where prohibited.

Limitation of Liability

IN NO EVENT SHALL EVGA OR OUR DIRECTORS, OFFICERS, EMPLOYEES, AGENTS OR OTHER REPRESENTATIVES BE LIABLE TO YOU OR TO ANY THIRD-PARTY CLAIMING THROUGH OR UNDER YOU, FOR ANY INDIRECT, SPECIAL, CONSEQUENTIAL OR INCIDENTAL DAMAGES. EVGA OR OUR DIRECTORS, OFFICERS, EMPLOYEES, AGENTS OR OTHER REPRESENTATIVES SHALL NOT BE LIABLE TO YOU OR TO ANY THIRD-PARTY FOR SUCH DAMAGES, INCLUDING ANY LOST PROFITS ARISING FROM OR RELATING TO THE PROMOTION AND THESE TERMS. IN ALL CIRCUMSTANCES, EVGA’S MAXIMUM LIABILITY SHALL NOT EXCEED THE AMOUNT OF 20% OF THE EVGA XR1 CAPTURE DEVICE’S MSRP. EVGA OR OUR DIRECTORS, OFFICERS, EMPLOYEES, AGENTS OR OTHER REPRESENTATIVES SHALL NOT, UNDER ANY CIRCUMSTANCES, BE LIABLE UPON A CLAIM OR ACTION IN CONTRACT, TORT, INDEMNITY OR CONTRIBUTION, OR OTHER CLAIMS RELATING TO THE PROMOTION WHICH EXCEEDS THIS LIABILITY LIMIT. EVGA OR OUR DIRECTORS, OFFICERS, EMPLOYEES, AGENTS OR OTHER REPRESENTATIVES SHALL NOT BE LIABLE FOR THIRD-PARTY CLAIMS FOR DAMAGES FOR DELAYS, INTERRUPTION OF SERVICE, LOSS OF BUSINESS, OR EXEMPLARY DAMAGES, WHETHER OR NOT EVGA HAS BEEN MADE AWARE OF THE POSSIBILITY OF SUCH CLAIMS OR DAMAGES.
