Official Rules

1. Prizes:

1.1 Three (3) Grand prizes: A trip for one (1) to take a flight in a L39 Albatros Fighter Jet. Includes: (a) 45 minutes of flight time with an experienced pilot, tentatively scheduled for December 2010 (the "Fulfillment Date"); (b) roundtrip coach air transportation for Grand Prize Winners on or around the Fulfillment Date from a major international airport. Details refer to section 7.

1.2 Two Hundred Fifty (250) prizes: A random drawing for a limited edition EVGA Jet Fighter themed T-Shirt, Size L or XL or XXL will be available.

2. Entry Period: The "Experience true 4G G-Force with EVGA GeForce GTS450 Contest" (the "Contest") commences at 10:00 a.m. (Pacific) on October 1, 2010 and ends at 11:59 p.m. (PST) on November 28, 2010 (the "Contest Period").  All entries must be received by 11:59:00 p.m. (Pacific) on November 28, 2010.  Any entries received after 11:59:00 p.m. (PST) on November 28, 2010 shall be void and ineligible for this Contest.

3. Eligibility: The Contest is open to legal residents of the United States, Canada, Europe and the Asia/Pacific Islands who are at least 18 years of age or older at time of entry. VOID WHEREVER PROHIBITED OR RESTRICTED BY LAW.  Employees (and their immediate families) of EVGA Corporation and its affiliated companies are not eligible. By participating in this Contest, entrants (a) agree to be bound by these Official Rules and by the decisions of EVGA Corporation, which are final in all matters relating to this Contest and (b) acknowledge compliance with these Official Rules.

4. To Enter: Go to http://www.evga.com/FlyGeForce450/ (the "Web Site") at any time during the Contest Period. Participants must be registered with a free EVGA member account.  All Participants must also electronically acknowledge and agree to the terms of EVGA Corporation's Privacy Policy and Term of Use.  All entries submitted in accordance with these Official Rules shall be collectively referred to hereinafter as the "Eligible Entries." You may enter only one (1) time, limit one prize per person or household. Incomplete or inaccurate entries are void.  All entries and entry materials become the property of EVGA Corporation and will not be returned.

5. Winner Selection/Notification: Two Hundred Fifty (250) Prize winners (the "Prize Winners") will be chosen randomly all eligible entries.  Prize Winners will receive a EVGA Jet Fighter themed t-shirt.  Three (3) Prize Winners will then be randomly chosen to win the Grand Prize referred to in Paragraph 2.1 (the "Grand Prize Winners"). One (1) Grand Prize Winner will be chosen from North America, Central America and South America, and one (1) of the Grand Prize Winners will be chosen from Europe, and one (1) of the Grand Prize Winners will be chosen from Asia/Pacific Islands. All Winning Eligible Entries will be posted on the EVGA Corporation Website at http://www.evga.com/FlyGeForce450/ on December 1, 2010 12:00 P.M. (PST) based on the criteria set forth in Paragraph 4. All decisions related to this Contest are final. EVGA Corporation expressly reserves the right to delay the announcement of the winners for creative or technical reasons or for any other reason EVGA Corporation deems it necessary. Following the announcement of the winners, EVGA Corporation will make a maximum of two (2) attempts to reach each chosen winners via email at the email address provided on his/her online entry form.  The winners will have Seven (7) days to respond and confirm participation. If a winner is, for whatever reason, unreachable or does not respond within Seven (7) days, an alternate winner may be selected based on the judging criteria set forth in Paragraphs 4, 5 and 6 from among all remaining Eligible Entries received.

6. Grand Prize (3): The Grand Prize Winners will receive a trip for one (1) to take a flight in a L39 Albatros Fighter Jet: (a) 45 minutes of flight time with an experienced pilot, tentatively scheduled for December 2010 (the "Fulfillment Date"); (b) roundtrip coach air transportation for Grand Prize Winners on or around the Fulfillment Date from a major international airport of EVGA Corporation’s choice near Prize Winner's residence to a major international airport of EVGA Corporation’s choosing in close proximity to the Contest Event Airport (Chino, CA); provided, however, if the Grand Prize Winner resides within 150 miles of the Chino, Airport (Chino, CA), ground transportation will be provided in place of air transportation; (c) one (1) night hotel accommodation of EVGA Corporation’s choice for Grand Prize Winners on or around the Fulfillment Date near the Chino, CA Airport (Chino, CA); (single room based on single occupancy; meals, telephone calls and other incidentals are not included).  The approximate retail value (the "ARV") of the Grand Prize is $6,000 and is subject to change based on current market conditions at the time of prize fulfillment. Arrangements for the fulfillment of all prizes will be made by EVGA Corporation. With respect to the Grand Prize: No person who is a minor in his/her jurisdiction of primary residence is eligible to win the Grand Prize.  By accepting the Grand Prize, the Grand Prize Winner acknowledges that the Grand Prize includes certain risks and assumes all liability in connection with such risks. In addition to the Affidavit/Release (as defined below) the Grand Prize Winner and his/her guest may be required to execute additional documentation and/or releases provided by the Contest Entities prior to claiming the Grand Prize, including, without limitation a medical release form in a format acceptable to the Contest Entities. Failure or refusal to execute the additional documentation and/or releases provided by the Contest Entities shall be grounds for disqualification and/or forfeiture of the prize.  The Fulfillment Date is tentatively scheduled for December 2010, however, EVGA Corporation reserves the right, and at its sole discretion, to modify the Fulfillment Date to a later date.  If Grand Prize Winner is not available to travel on the dates specified by EVGA Corporation in its sole discretion, then all privileges as Grand Prize Winner will immediately be terminated. Grand Prize Winner is responsible for all expenses, fees, taxes and costs not expressly described but not limited, to hotel incidentals, transportation, meals and gratuities.

For all Prizes: No substitution or transfer of the prizes or any portion thereof is permitted, except by EVGA 
Corporation, in which case a prize of equal or greater value may be awarded. The value of the prizes may be taxable to the Winners as income. Upon receipt of a prize, or before if required by law, Winners are required to comply with any and all applicable federal, state and local laws, rules and regulations. Winners are solely responsible for any and all applicable federal, state and local taxes that become due with respect to their respective prizes. The total ARV of all prizes awarded in this Contest is $25,000.

7. Winner Verification: Each Grand Prize Winner must sign (a) an affidavit of eligibility and (b) a release  releasing EVGA Corporation (collectively, the "Contest Entities") and their  respective parent companies, officers, directors, employees, agents, members, affiliated companies and  subsidiaries, from any and all liability, claims, demands, and causes of action for personal injury and/or  damage, theft, loss, or any other harm suffered in connection with this Contest or the use or acceptance of any prize or any portion thereof to be eligible for the prizes; and (b) except where prohibited, a promotional release granting EVGA Corporation the right to use his or her name and likeness for advertising and publicity purposes without additional compensation. Entry into this Contest constitutes all participants' agreement to sign such releases. Winners must also complete any additional legal documents provided by EVGA Corporation (or third party on its behalf, if applicable) with respect to all prizes and return them as instructed within the timeframe specified by EVGA Corporation. Noncompliance may result in disqualification. ANY VIOLATION OF THESE OFFICIAL RULES BY A WINNER WILL RESULT IN SUCH WINNER'S DISQUALIFICATION AS A WINNER OF "Experience true 4G G-Force with EVGA GeForce GTS450 Contest" AND ALL PRIVILEGES AS A WINNER WILL BE IMMEDIATELY TERMINATED.

8. Disclaimer of Warranties: The Contest Entities and their respective parent companies, officers, directors, employees, agents, members, affiliated companies and subsidiaries hereby make no warranties and hereby disclaim any and all warranties, express or implied, concerning any service or products provided by any third party in connection with the Contest.

9. Past experience has confirmed that contests and other competitions generate substantially similar submissions or entries which closely resemble concepts and ideas that have been independently developed by EVGA Corporation before or after the Contest. Accordingly, entrants may subsequently see an EVGA Corporation presentation which seemingly incorporates an idea or concept or includes materials similar to that contained in their entries. Any similarity is purely coincidental and unavoidable in light of the volume of ideas which EVGA Corporation routinely considers in the course of its program development. Because of this possibility, entrants hereby agree to submit their entries under the following terms and conditions: (a) that EVGA Corporation may use any ideas, concepts, material, in whole or in part, contained in an entry, (b) that all materials submitted become the property of EVGA Corporation and will not be returned; (c) that all materials submitted are free from any lien or claim by anyone, including, but not limited to any union, guild or performance rights society; (d) entrants have obtained all rights,  permissions and licenses necessary for EVGA Corporation to use the entries for any purpose; (e) that no entry or any part thereof infringes any trademark or copyright or otherwise violates anyone's right of privacy or publicity; and (f) entrants indemnify and hold harmless EVGA Corporation and their respective parent companies, officers, directors, employees, agents, members, affiliated companies and subsidiaries from any claims, suits, losses damages and expenses (including reasonable attorneys' fees) that arise from any breach of the foregoing conditions. Entrants agree to the foregoing and in addition agree to obtain, upon request of EVGA Corporation documentation and releases necessary to prove their unrestricted ownership in all materials contained in their submission and EVGA Corporation's right to use such materials, in whole or in part, without limitation in all media and for any purpose whatsoever without compensation.

10. Severability:  In the event any term, covenant, condition, or other provision stated herein is held to be invalid, void, or illegal, the same shall be deemed severed from the remainder sections of the Official Rules and shall in no way affect, impair or invalidate any other term, covenant, condition, or other provision herein.  If any term, covenant, condition, or other provision herein is held to be invalid due to its scope or breadth, such term, covenant, condition, or other provision shall be deemed valid to the extent of the scope of breadth permitted by law.

11. General Terms: The odds of winning will depend on the number of entries received.  The Contest Entities assume no responsibility for incorrect or inaccurate entry information whether caused by any of the equipment or programming associated with or utilized in this Contest or by any human error which may occur in the processing of the entries in this Contest. The Contest Entities are not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or players on account of technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials in this Contest. If, for any reason, the Contest is not capable of running as planned, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Contest Entities which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, the Contest Entities reserve the right in their sole discretion to cancel, terminate, modify or suspend the Contest. Should the Contest be terminated prior to the stated expiration date, notice will be posted on www.evga.com and the prizes may be awarded to winners to be selected from among all Eligible Entries received up until the time of termination. All interpretations of these Official Rules and decisions by the Contest Entities are final. The Contest Entities reserve the right in their sole discretion to disqualify any individual it finds to be tampering, or has tampered with the entry process or the operation of this Contest; to be acting in violation of these Official Rules; or to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person or to have provided inaccurate information on any legal documents submitted in connection with this Contest. CAUTION: ANY ATTEMPT BY ANY INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, EVGA CORPORATION RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. THE CALIFORNIA COURTS (STATE AND FEDERAL) SHALL HAVE SOLE JURISDICTION OF ANY CONTROVERSIES REGARDING THE CONTEST AND THE LAWS OF THE STATE OF CALIFORNIA SHALL GOVERN THE CONTEST. EACH ENTRANT WAIVES ANY AND ALL OBJECTIONS TO JURISDICTION AND VENUE IN THESE COURTS AND HEREBY SUBMITS TO THE JURISDICTION OF THOSE COURTS.

Eligibility: Program is only open to EVGA members that have registered with EVGA. Registration to become an EVGA member is free on our website at www.evga.com. To sign up for a chance to take part in EVGA Try GTS 450 Program please carefully read through the terms and conditions and check the box and click the enter button. Once you check the "I Agree" button and hit enter you will automatically be placed into a waiting list to have a chance to partake in the EVGA Try GTS 450 Program. EVGA will randomly choose 150 Participants who will receive the product. Each person may only enter once; multiple registrations/ entries will be disqualified. No purchase is necessary; it will not increase your chances of receiving a product. All employees of EVGA, its parent, affiliates and subsidiaries, and the immediate families and household members of each, are not eligible in submitting an entry to participate in this program. EVGA may at its discretion limit the amount of Participants at any time.

How Program Works: Once a Participant has been randomly selected by EVGA, the Participant will receive an email with a link (URL) to a page to pay $65.00 (USD), applicable taxes apply, as collateral.  Participants will have 30 days to try the product before they decide to keep it or return it.  If the Participant wishes to keep the product, EVGA will keep the collateral and you will then own the product.  If the Participant wishes to return the product, EVGA will refund the collateral and send a return shipping label.  EVGA may revoke responsibility for shipping charges at any time.  Users that already own a GTS 450 will still be eligible for this promotion.

Program Requirements: by choosing to participate in Try GTS 450 program, all qualified Participants must agree to these requirements and be bound by these Terms.

Participants must report any damages or problems with the product within 24 hours of receiving the product by contacting EVGA customer service.

Please inspect the product and report right away when you receive the product if you notice any physical damages. Once the product is in the participant’s possession for over 24 hours, EVGA will hold participant responsible and liable for the product. Any physical damage or loss of product will be billed to the participant, and participant will be liable to pay the ARV of the Product to EVGA CORP, upon 30 days from receiving bill.

Use of Winner's Name, Information, and feed back: By entering, each entrant grants permission, without further compensation, to EVGA and their agents and licensees, to use the entrant's name, information, feedback, statements, and submitted material for print and promotional purposes in connection with the Program. EVGA also reserves the right to remove any post or feedback that EVGA feels is inappropriate or out of context.

Products loaned and shipped are without warranty of any kind from EVGA, express or implied, without limitation, except where this would be contrary to federal, state, provincial, or local laws or regulations. All federal, state, provincial and local laws and regulations apply. EVGA at its sole discretion shall reserve the right to disqualify any Participant from the Program if it reasonably believes that the Participant has attempted to undermine the legitimate operation of the Try GTS 450 Program by cheating, deception, or other unfair practices or abuses, threatens or harassment of any other Participants, EVGA employees and affiliates.

At any time EVGA may request any Participant to return the product back to EVGA and the Participant will be refunded the collateral upon receipt of the product in working condition.

Limitations of Liability: By participating, You agree that all use of the product and its contents is at your own risk and you agree to release EVGA, and their officers, directors, employees and agencies from any claim, loss, liability, damage or injury of any kind arising from your participation in the program or your receipt or use of the loaner product.

Product Substitutions and Changes in Terms: EVGA may, at their discretion, substitute change in product type or alter the product and program details at any time, with or without notice to you. EVGA can end the program or may change the Terms in the terms and conditions at any time. You agree to review the Terms periodically to ensure awareness of any changes.

Any and all disputes, claims and causes of action arising out of or connected with this program, or any of the products passed into possession, shall be resolved individually, without resort to any form of class action, and exclusively by arbitration. Claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in this program, but in no event attorney’s fees. These Terms and Conditions shall be governed by, subject to, and construed in accordance with the laws of the State of California, United States of America, excluding all conflict of law rules. If any provision(s) of these Terms are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.
