Picture EVGA In Your Hometown!

This is a brand new promotion, the first time it has ever been tried here for our anniversary! We want you to take a picture of anything EVGA branded in your hometown. This can be a box, a lanyard, a shirt, a hat - anything with the EVGA logo!

There are six categories with one winner per category. We will judge the best 2D photo and the best 3D photo as judged by EVGA staff. Points are given for creativity, humor or even audacity. If you choose to enter a 3D photo there might be less competition, but the 3D effect will be judged as well. Keep in mind, no laws can be broken in order to pull your entry off. There are no points given for Darwin Award runner ups or winners. We will also have prizes for Honorable Mentions in both 2D and 3D images. On top of this, there will be two random winners selected from all entries, one from the 2D category and one from the 3D category, regardless of how funny or good they are - so everyone will have a chance to win something just for showing EVGA off!

We want pictures to be outside (yes, you have to go outside) and unaltered. The only exception is to alter a 2 dimensional photo if you wanted to enter in the 3D category instead. You may only enter one photo, so you have to decide if you want to make it 3D or 2D before you enter. You can take the picture with any digital camera, phone, etc. We care about quality of content, not quality of pixels.

On main street
In front of a local landmark
Or anything you can think of - as long as it's safe and legal!

We do not recommend removing your EVGA product from your system and take it outside for this promotion.

CONTEST AND OFFICIAL RULES:

The contest begins on 07/15/11 at 12:00 p.m. Pacific and submissions will be accepted until 08/07/11 at 11:59 PM Pacific. The contest consists of 3 phases as set forth below.

Phase 1) Submission : Starts 07/15/11 - Ends 08/07/11
Phase 2) Judging and Random Drawing: Starts 08/08/11 - Ends 08/10/11
Phase 3) Winners announced: 08/11/11 by 12:00 PM Pacific

There are two categories of photographs: 2 Dimensional (2D) photographs and 3 Dimensional (3D) photographs.  2D photographs are those images taken by a non-3D camera and are otherwise unaltered.  3D photographs are those taken by a 3D camera, or altered by software to look 3D (anaglyph or otherwise).

Each person may submit only one (1) photograph.  Photographs must be unaltered except to resize to fit within the parameters of the contest requirements or to change a 2D photograph into 3D in the absence of a 3D camera.

All employees of Sponsor, its parent, affiliates and subsidiaries, and the immediate families and household members of each, are not eligible in submitting a entry to participate in this contest.

By submitting an entry, participant agrees to be bound by these Official Rules.

Entries that are lewd, obscene, or otherwise inappropriate to the Contest will be disqualified at EVGA's sole discretion.

Participants warrant that their Entries are original and that they are the sole and exclusive owner and rights holder of the submitted Entries and that they have the right to submit the Entries in the Contest and grant all required licenses. Each Participant agrees not to submit any Entry that (1) infringes any third party proprietary rights, intellectual property rights, industrial property rights, personal or moral rights, or images depicting any recognizable athletes, celebrities, animals, animated characters, objects or any other rights, including without limitation, copyright, trademark, patent, trade secret or confidentiality obligations; or (2) otherwise violates applicable U.S. law or the law of the Participant's country of residence.

The submitted photograph must not contain material that is inappropriate, indecent, pornographic, hateful, tortuous, slanderous, libelous, or defamatory against other people or companies

The submitted photograph must not contain material that promotes bigotry, racism, or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age.

Sponsor is not responsible for late, lost, incomplete, illegible, misdirected or misrouted entries, electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission.

Submitted entries become the property of EVGA and will not be returned.

EVGA reserves the right to deny and delete any Photo that is submitted for this contest for any reason.

Acceptable File format - .JPG, .GIF, .PNG ONLY

Acceptable File Size - 1680 pixels Wide by 1050 pixels High at minimum and 2560 pixels Wide by 1600 pixels High at maximum and no larger than 2MB in size.

JUDGING:

Qualified judges determined by EVGA in its sole discretion will do the Judging and select the Best Overall Photo grand prize winner, and a first, second, and third place winner. Judging will be based on Originality, Clarity of idea, and best use of EVGA branding.

RANDOM DRAWING:

Qualified images will be pooled and a winner from the 3D category and a winner from the 2D category will be selected from at random by a 3rd party selector.

EVGA reserves the right to substitute an alternate prize of equal or greater value in the event all or part of a prize set forth above becomes unavailable. No cash substitute or transfer of prizes is available.  Prizes are awarded without warranty of any kind from EVGA, express or implied, without limitation, except where this would be contrary to federal, state, provincial, or local laws or regulations. All federal, state, provincial and local laws and regulations apply. Submission of an Entry in this Contest constitutes agreement by the Participant to the terms and conditions of these Rules. Decisions of EVGA and the Judges are final and binding on all matters pertaining to this Contest. Return of any prize/prize notification may result in disqualification and selection of an alternate winner. Any potential winner who cannot be contacted by email within 14 days of attempted first notification will forfeit his/her prize. Potential prize winner(s) and their parents/legal guardians may be required to sign and return an Affidavit or Declaration of Eligibility, a Liability/Publicity Release within 30 days following the date of first attempted notification. Failure to comply within this time period may result in disqualification and selection of an alternate winner. EVGA at its sole discretion shall reserves the right to disqualify any Participant from the Contest if it reasonably believes that the Participant has attempted to undermine the legitimate operation of the Contest by cheating, deception, or other unfair playing practices or abuses, threatens or harassment of any other Participants, EVGA employees and affiliates, or the Judges.

Use of Winner's Name & Information: By entering, each entrant grants permission, without further compensation, to EVGA and their agents and licensees, to use the entrant's name, information and submitted material for Broadcast, print and promotional purposes in connection with the contest.

Limitations of Liability: By entering, entrants agree to release EVGA, and their officers, directors, employees and agencies from any claim, loss, liability, damage or injury of any kind arising from their participation in the contest or their receipt or use of the contest prize.

Winner is responsible for all federal, state and local taxes associated with acceptance and use of prize.

Any and all disputes, claims and causes of action arising out of or connected with this contest, or any prize awarded, shall be resolved individually, without resort to any form of class action, and exclusively by arbitration. Claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this contest, but in no event attorney's fees. These Official Rules shall be governed by, subject to, and construed in accordance with the laws of the State of California, United States of America, excluding all conflict of law rules. If any provision(s) of these Official Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect. To the extent permitted by law, the rights to litigate, seek injunctive relief or make any other recourse to judicial or any other procedure in case of disputes or claims resulting from or in connection with this Contest are hereby excluded, and all Participants expressly waive any and all such rights.
