The products for Loaner Program are selected by EVGA Corporation and will remain the property of EVGA Corporation:

Eligibility: The program is only open to legal residents of the 48 Continental States and Canada. Program is only open to EVGA members that have registered with EVGA. Registration to become an EVGA member is free on our website at www.evga.com. To sign up for a chance to take part in EVGA Loaner Program please carefully read through the terms and conditions below check the box and click the enter button. Once you check the” I Agree” button and hit enter you will automatically be placed into a waiting list to have a chance to partake in the EVGA Loaner Program. EVGA will randomly choose Participants who will receive the loaner product. EVGA does not guarantee that all Participants will be able to participate in the program or receive a loaner product. Each person may only enter once; multiple registrations/ entries will be disqualified. No purchase is necessary; it will not increase your chances of receiving a loaner product. All employees of EVGA, its parent, affiliates and subsidiaries, and the immediate families and household members of each, are not eligible in submitting an entry to participate in this program. EVGA may at its discretion limit the amount of Participants at any time.
How Program Works: Once a Participant has been randomly selected by EVGA, the Participant will receive an email and their status will change and update on My ELP Page. EVGA will ship out the selected Loaner product to the randomly chosen participants in the queue for each region. Once those Participants receive the product they will have 14 calendar days from the date the product arrived to test out the product. Once the 14 calendar days is up, EVGA will randomly choose the next Participants and the Participants who currently has the loaner product must send out and pay for the shipping cost to send the loaner product to the next chosen Participant within his or her region. EVGA will provide the Participant with the person that they will need to send the loaner product to, and information will be updated on My ELP Page. The Participant must go to My ELP Page, once loaner product is shipped out and click yes that product was shipped and also provide the tracking number.
Program Requirements: by choosing to participate in loaner program, all qualified Participants must agree to these requirements and be bound by these Terms.
Participants must report within 24 hours of receiving the loaner product by checking in the product on My ELP Page.
Please inspect the product and report right away when you receive the product if you notice any physical damages. Once the product is in the participant’s possession for over 24 hours, EVGA will hold participant responsible and liable for the product. Any physical damage or loss of product will be billed to the participant, and participant will be liable to pay the ARV of the Loaner Product to EVGA CORP, upon 30 days from receiving bill.
The participant will have 14 Calendar days, starting from the time product is received to test and provide feedback for the loaner product.
Participants who receive the loaner product are required to post feedback comments on My ELP Page within 7 days from shipping out product to next participant.
Once the 14 calendar days is up, participant agrees to ship out and pay for all related shipping costs to ship the Loaner Product to the next participant on the waiting list that EVGA designates. EVGA will provide you with the next participant’s name and mailing address. The Loaner product must be packaged up in original form with all original contents included and secured for safe shipping. The Loaner product must be shipped out using standard shipping with UPS (United Parcel Services) and must choose deliver with adult signature. Please email EVGA and the next participant once the loaner product is shipped, with the tracking number and date product was shipped.
Please Note: by agreeing to participate in the Loaner program you are agreeing and allowing EVGA to give out your information in regards to your full name and address to other EVGA members associated with the Loaner Program.
Use of Winner's Name, Information, and feed back: By entering, each entrant grants permission, without further compensation, to EVGA and their agents and licensees, to use the entrant's name, information, feedback, statements, and submitted material for print and promotional purposes in connection with the Program. EVGA also reserves the right to remove any post or feedback that EVGA feels is inappropriate or out of context.
Products loaned and shipped are without warranty of any kind from EVGA, express or implied, without limitation, except where this would be contrary to federal, state, provincial, or local laws or regulations. All federal, state, provincial and local laws and regulations apply. EVGA at its sole discretion shall reserve the right to disqualify any Participant from the Program if it reasonably believes that the Participant has attempted to undermine the legitimate operation of the Loaner Program by cheating, deception, or other unfair practices or abuses, threatens or harassment of any other Participants, EVGA employees and affiliates.
At any time EVGA may request any Participant to return the loaner product back to EVGA.
Limitations of Liability: By participating, You agree that all use of loaner product and its contents is at your own risk and you agree to release EVGA, and their officers, directors, employees and agencies from any claim, loss, liability, damage or injury of any kind arising from your participation in the program or your receipt or use of the loaner product.
Product Substitutions and Changes in Terms: EVGA may, at their discretion, substitute change in loaner product type or alter the product and program details at any time, with or without notice to you. EVGA can end the program or may change the Terms in the terms and conditions at any time. You agree to review the Terms periodically to ensure awareness of any changes.
Participant is responsible for all shipping cost and federal, state, and local taxes associated with shipping loaner product to next Participant.
Any and all disputes, claims and causes of action arising out of or connected with this program, or any of the products passed into possession, shall be resolved individually, without resort to any form of class action, and exclusively by arbitration. Claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in this program, but in no event attorney’s fees. These Terms and Conditions shall be governed by, subject to, and construed in accordance with the laws of the State of California, United States of America, excluding all conflict of law rules. If any provision(s) of these Terms are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect. To the extent permitted by law, the rights to litigate, seek injunctive relief or make any other recourse to judicial or any other procedure in case of disputes or claims resulting from or in connection with this program are hereby excluded, and all Participants expressly waive any and all such rights.
