KINSTON SSD DRIVE COMMUNITY RANDOM DRAWING OFFICIAL RULES: Entry to Drawing begins on 02/01/10 at 9:00 a.m. Pacific Standard Time (PST) and submissions will be accepted until 02/14/10 at 11:59 p.m. (PST). NO REGISTRATION FEE, PURCHASE OR PAYMENT IS NECESSARY TO ENTER OR WIN. Requirements to Participate: • You are a registered EVGA User and a participant in the EVGA Forums (registration is free through EVGA website). • You must post your system to EVGA MODSRIGS with at least 2 photos and current hard drive solution detailed on MODS RIGS as a public system (http://www.modsrigs.com ) • You must also post in a specific thread how an SSD drive will improve your system performance. • All forum post entries must have a valid MODSRIGS system *Please note this is a Random Drawing and not a contest, your entry of your system and posts is only used as a valid form of verification. All employees of Sponsor, its parent, affiliates and subsidiaries, and the immediate families and household members of each, are not eligible in submitting an entry to participate in this Drawing. By submitting an entry, participant agrees to be bound by these Official Rules. Participants warrant that their Entries are original and that they are the sole and exclusive owner and rights holder of the submitted Entries and that they have the right to submit the Entries in the Drawing and grant all required licenses. Each Participant agrees not to submit any Entry that (1) infringes any third party proprietary rights, intellectual property rights, industrial property rights, personal or moral rights, any other rights, including without limitation, copyright, trademark, patent, trade secret or confidentiality obligations; or (2) otherwise violates applicable U.S. law or the law of the Participant's country of residence. Sponsor is not responsible for late, lost, incomplete, illegible, misdirected or misrouted entries, electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission. Submitted entries become the property of EVGA and will not be returned. EVGA reserves the right to deny and delete any submission that is submitted for this Drawing Drawing and Prize Process: All qualified entries with valid posts that meet the requirements will be included into the random drawing and (5) five winners will be picked at random. Odds of winning are dependant upon number of eligible entries received at the time of the drawing. Winners will be selected and posted to the EVGA website on 02/17/10 at 12:00p.m. (PST) All decisions are final and binding. Use of Winner's Name & Information: By entering, each entrant grants permission, without further compensation, to EVGA and their agents and licensees, to use the entrant's name, information and submitted material for Broadcast, print and promotional purposes in connection with the Drawing. Limitations of Liability: By entering, entrants agree to release EVGA, and their officers, directors, employees and agencies from any claim, loss, liability, damage or injury of any kind arising from their participation in the contest or their receipt or use of the Drawing prizes. Winner is responsible for all federal, state, local taxes, fees, and any applicable withholdings and reporting requirements associated with acceptance and use of prize. Any and all disputes, claims and causes of action arising out of or connected with this Drawing, or any prize awarded, shall be resolved individually, without resort to any form of class action, and exclusively by arbitration. Claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this contest, but in no event attorney's fees.
