To participate in this program, you must read and agree to the terms and conditions
You will receive your Affiliate Code via email, and it will also be listed on your account profile
This program applies only to friends, family, etc. You cannot use your own code to enter the contest and gain EVGA bucks.
In order to receive credit for your Affiliate Code, your sponsor must upload a valid invoice from their 'My Products' page.
All Affiliate Rewards will be given out on the third business day of the month so everyone has time to upload invoices.

EVGA’s Affiliate Program begins on November 09, 2009

Eligibility:

To enroll in the Affiliate Program, you must be a registered EVGA user in good standing (registration is free through EVGA’s website), subject to and in compliance with the requirements of these Terms and Conditions.

How the Affiliate Program works: 
To participate in this program, you must read and agree to theses terms and conditions.

Every registered EVGA.com member will be given a unique Affiliate Code they can give out to anyone they wish.

Once you have read and agree to these terms and conditions and click the I Agree Button You will receive your Affiliate Code via email, and it will also be listed on your account profile.

Every time your Affiliate Code is used by someone else when registering a product, you will receive 2 EVGA Bucks after verification.  Please see EVGA Bucks terms and conditions and usage at http://www.evga.com/evgabucks/.

Every time your Affiliate Code is used, you will also be entered into a random drawing and have a chance to win the grand prize in the same month your code was used.

Acceptance into the Program is at EVGA’s sole discretion, which may be withheld for any reason or no reason at all. EVGA reserves the right, in its sole discretion, to suspend or cancel the EVGA Affiliate Program at any time with or without reason. EVGA reserves the right to introduce new eligibility requirements for this Program at any time without notice.

Nothing in these terms and conditions nor any conduct or participation of either party shall be deemed to constitute an employment or agency relationship.

All Employees of EVGA, its parent, affiliates and subsidiaries, and the immediate families and household members of each, are not eligible in submitting an entry to participate in this EVGA Affiliate Program or Drawing.

EVGA is not responsible for late, lost, incomplete, illegible, misdirected or misrouted entries and registrations, electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission.

Drawing and Prize Process:

All qualified entries with valid Affiliate code used by someone they referred, will be included into the random drawing for that month that their code was used. EVGA will verify the number of qualifying referrals for each Referee at the end of each calendar month. (1) One winner will be picked at random at the end of each calendar month.  Odds of winning are dependant upon number of eligible entries received at the time of the drawing for the month. Winners will be selected and posted to the EVGA website on a monthly basis.  All decisions are final and binding.

EVGA reserves the right to substitute an alternate prize of equal or greater value in the event all or part of a prize set forth above becomes unavailable. No cash substitute or transfer of prizes is available.  Prizes are awarded without warranty of any kind from EVGA, express or implied, without limitation, except where this would be contrary to federal, state, provincial, or local laws or regulations. All federal, state, provincial and local laws and regulations apply. Decisions of EVGA are final and binding on all matters pertaining to this Program and Drawing. Return of any prize/prize notification may result in disqualification and selection of an alternate winner. Any potential winner who cannot be contacted by email within 15 days of attempted first notification will forfeit his/her prize. Potential prize winner(s) and their parents/legal guardians may be required to sign and return an Affidavit or Declaration of Eligibility, a Liability/Publicity Release within 30 days following the date of first attempted notification. Failure to comply within this time period may result in disqualification and selection of an alternate winner. EVGA at its sole discretion shall reserves the right to disqualify any Participant from the Program and Drawing if it reasonably believes that the Participant has attempted to undermine the legitimate operation of the Program by cheating, deception, or other unfair playing practices or abuses, threatens or harassment of any other Participants, EVGA employees and affiliates, or the Judges. EVGA reserves the right to suspend access to your account indefinitely pending investigation.
Privacy Policy: Information supplied by entrants will be shared by Sponsor in accordance with its privacy policy, posted at  http://www.evga.com/privacy.asp
Use of Winner's Name & Information: By entering, each entrant grants permission, without further compensation, to EVGA and their agents and licensees, to use the entrant's name, information and submitted material for Broadcast, print and promotional purposes in connection with the Drawing.

Limitations of Liability: By entering, entrants agree to release EVGA, and their officers, directors, employees and agencies from any claim, loss, liability, damage or injury of any kind arising from their participation in the Program or their receipt or use of the Drawing prizes.

Winner is responsible for all federal, state, local taxes, fees, and any applicable withholdings and reporting requirements associated with acceptance and use of prize.

Any and all disputes, claims and causes of action arising out of or connected with this Drawing, or any prize awarded, shall be resolved individually, without resort to any form of class action, and exclusively by arbitration. Claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Program, but in no event attorney's fees. These Terms and Conditions shall be governed by, subject to, and construed in accordance with the laws of the State of California, United States of America, excluding all conflict of law rules. If any provision(s) of these Terms and Conditions are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect. To the extent permitted by law, the rights to litigate, seek injunctive relief or make any other recourse to judicial or any other procedure in case of disputes or claims resulting from or in connection with this Program and Drawing are hereby excluded, and all Participants expressly waive any and all such rights.
