I sold a working DVR to a woman in Australia (not many of us having luck with that place are we) and I get a notice stating she was issued a refund because it's not as described and that it was supposedly smoking. 
 
Im about to be burned $500 and I still have a credit card on file with paypal.  I'm thinking I better cancel my credit card before crap gets out of hand.
 
I paid for shipping insurance but I'm so stressed right now I can't seem to locate the link needed to direct me to see if I can dodge this bullet via insurance claim.
 
I'm so........GAH I can't describe it.  I gave this woman a HUGE discount on the item, and this is how I get repaid. 
 
For all I know she shorted out the unit by doing God knows what and now I'm supposed to take this hit and on top of it all I'm out not only the $500, but my freakin DVR as well!  I should have packed that DVR with a brick of C4 just in case it came to this. 
 
My head isn't clear and I'm not sure what to do with this woman thousands of miles away holding my account hostage.
 
 
I can't believe I forgot to pull my credit card from paypal after paying for that label.   I don't want to cancel my credit card, because they've been so good to me, but I don't want to find out how well they'll take care of me when I open a claim to have my paypal chargeback charged back.
 
If anyone has won a paypal dispute or has any advice please post.  I'm mind is far from clear right now and I feel like there is a thundercloud in my chest.

    Doesn't Australia use 220? 
     
    I would cancel the card or tell your credit card company you'll dispute any refund from Paypal.

      Now I've got to figure out what to do with online sales... Can I just open a new paypal account, does it have to be tied to a new email, will an old email flag the account..... bah >.< 
       
      The dispute is still open but I can't find my insurance number in my paypal account.  I hope I got a print screen.
       
       
      I am WAY too trusting of people.
       
      I don't want to issue a refund, but since it looks like one was already issued, I want my now broken DVR back... but then I have a useless paperweight and I have to issue a 100% refund since the item was returned......  
       
      I wonder if I can at least give her bad feedback.

        PayPal won't give her the money back until you receive the DVR back.

          Just say you lost the card and your credit card will be cancelled and they will send you a new one linked to the account. No need to close accounts with them or anything. But paypal will limit your paypal forever if you do that and don't send her the money(if she wins). But she will need to provide proof to paypal that it is actually not working correctly. You can always say a family member saw you tested it right before shipping. Then you packaged and shipped it. It may not be true but it greatly helps your odds.

              I had someone sell me a motherboard and then cancelled their ebay account and took my money.
              After WEEKS and WEEKS of complaining, form filling and calling, paypal recovered about half what I lost. 5 minutes on google and it was apparent that I was one of MANY people that got scammed but no one did a thing. I even had the creeps cell number and license plate numbers because he was careless on the interwebz and still no one did a thing. I called the local police department and sent them pages and pages of proof that this guy has ripped people off and nothing happened at all. I bet if I googled him, there will still be people getting ripped by him. If I ever go to Canada, I'm punching that kid right in his mouth.

                This could be the case if it is a older dvr, Heck even some of the newer ones. A lot electronics now support 120 and 240 though.

                  thanks for all the help guys, the back of the DVR said it could do 110-240v 2A,  maybe her Amps were off?  I don't think she read the manual, after telling her to do so I just got incoherent blurbs of bad English in ALL CAPS.[<font]  I wonder if the PSU had a switch for 240 and she didn't select her proper voltage.  I don't know, but that thing was sweet, and I offered a refund for the item price only,  but I know she ruined it.  She hasn't replied to my counter offer so I think I'll just contact paypal and let them know that she fried it.  I have a witness that can verify it worked, and my tech department *cough* evga forums *cough* has assessed that based on her claims, she had somehow used incorrect voltage settings.

                      I don't know if I put AS IS in the description, but I did put all sales final/no returns.  I guess I need to lengthen my small print :/
                       
                      I've had 100% feedback for over half a decade, I'd hate to see her ruin it.
                      guess I did state as is:
                      All items are inspected prior to shipment to guarantee quality. Any present defects will be listed in description and shown in current display image. All items are sold as is. No returns.

                        A big +1 on this!! It saved me $275.00 last month on a Koolance cooling unit I sold on Flebay. The guy tied to claim it was leaking when he hooked it up. I had dated pictures and video of the unit working and NOT leaking the day before I shipped it.
                        As far as leaving negative feedback for the buyer....NOPE! Fleabay took the right of sellers to post negative feedback away a long time ago. Total BS!
                         Also, the AS IS means NOTHING on Flebay sales. Not as far as PayPal is concerned anyway.

                            you can do either.   I just keep it just in case.  I've sold two ipads and I show the ipad working, the date on the computer after I google the date to show it's the day I shipped it and took the video.  There's no dispute of when the video was taken when you google today's date.

                              Sorry to hear about this. This is my biggest fear about selling stuff online. I really feel for you man. If you end up being out either the money or DVR or god forbid both it will not be cool at all. Paypal does seem to be designed to only protect the buyer which is complete BS. Don't they realize that some buyers are morons and/or scammers? I really wish there was a viable alternative to Paypal. I guess amazon payments, but I haven't really looked into it.                                   • She has to return the item and provide shipping info on it.
                                  • If paypal all ready has your credit card info and locked down your account from the dispute, it's too late to take any action. Even canceling your card will not stop it from taking your money.
                                  • State your situation clearly in the dispute, if it was 100% functioning before you shipped it off, make sure to stick to that.                                     OK guys, How does this sound:
                                     
                                    To whom it may concern regarding my current open dispute, I have recently sold and shipped a working closed circuit television digital video recorder that was tested and inspected prior to listing and shipping.  I even recorded extensive test footage onto the hard drive of the machine to confirm that it does indeed work.  I received an email from the buyer stating that the machine would turn itself off when connected to her cameras.  I attempted to troubleshoot the issue for her, free of charge, but all I got was short, incoherent responses in broken English.  She continued to use the machine without correcting her issue, and somehow bypassed the machine’s safety shutoff and ended up breaking the unit. 
                                    Based on her description of it turning itself off automatically when she attempted to utilize the machine with her camera equipment, it sounds like she did not properly set up the machine to conform to Australia power use, as this item was in used condition from the USA, listed in used condition, and shipped in that condition.  I cannot confirm what her actual power draw is, what the draw if her cameras were, or any other variables that exist outside of the unit itself.  The unit was successfully tested, and had several hours of continuous video recorded onto the drive prior to shipment; had the unit not been able to stay on for a minute or so at a time, it wouldn’t have been able to record said video.  If a signed statement is needed, I have eyewitnesses that can verify that the machine was in fact in working order, and did not have any of the claimed issues whatsoever.  I have had 100% feedback for the entire five plus I have been an eBay seller, and I have in fact sold used electronics before in the past without any issue or complaints.  I feel that the buyer does not have a valid claim, as it seems her issues are due to user error.

                                            I have to respond to the claim now, I submitted that wall of text, but I guess the robots can't find my points of argument in there.  The buyer slipped up and stated that "it stopped working,"  so I'm trying to word a response pointing out that at sometime in her possession it did in fact work, and that by her misuse it "stopped working."  She should have taken the partial refund when I offered, I've lost that sense of dread I had and am willing to go head to head with her now.  I'm getting a witness statement written up for me and will submit it with my pointing out that she did have it working at some time. 
                                             
                                             
                                            Do you think this lady realizes that even if they rule in her favor, she is going to have to spend $150 just to ship it back to me?  Or am I supposed to pay for that too >:/

                                              You know paypal can not and will not charge your CC here in the states to cover an item dispute or your bank account, by law they are not allowed to without your premission, I ran into this, they had a CC on file on an old account, and it got shut down due to a bogus dispute and said -118 dollars for the last 4 years, I talked them down to 50 dollars and i paid that, but they are in no way legally allowed here in the states at least to charge your CC or Bank account without your authorization doing so amounts to bank fraud :D

                                                I had so many issues with my papal account. On about 3 occasions they withdrew money from my account for eBay purchases I did not make and overdrew my checking incurring fees and making me late on bills. Each time I had to file a claim with my bank. They would routinely lock my account with my funds in it until I had obtained writing from the buyers claiming they received my items. One guy in another country begged me to sell him my corsair 2000mhz cas7 ram kit and I told him no. He offered me so much money for it, I couldn't refuse. I sold him the kit and after a month he filed a claim and said one of the modules did not work. I offered to help him RMA but he refused and filed the claim anyways. Paypal pulled the money out of my checking. I called my bank and told them Paypal took my money without my authorization for a purchase I did not make. The bank reversed the charge and I was hounded by PayPal for a year, threatening me and my credit. I changed all my numbers and banks and never heard from them again. I've been using my wife's PayPal for years now (linked to our joint account) and never had a single issue. My last account was on some kind of obvious black list where they said everything I sold or did was suspicious activity and they would lock down my money.                                                         Just remember to put "as is" on any sale from now on. You can tell them it works, but if the shipping people screw it up, or that lady breaks it, then you dont have to worry about the refund. 
                                                         
                                                        But most people here have the right. Tell the credit card company to deny the refund to paypal. Dispute it with paypal. And subsequently profit.

                                                          Send paypal an email regarding the case from the beginning of transaction. Better if you call and contact them.   Be honest to them. Ifyou  try to lie they would find it out and the case will be put against you.

                                                            I can't freakin' believe it. 
                                                             
                                                            I basically submitted a letter in timeline form of both parties conversations and bolded when the buyer stated: "it STOPPED working" as to brand it into the reviewer's mind that it did in fact work when shipped and that after her screwing with it it ended up no longer working and that I sold it as is. 
                                                             
                                                             
                                                             
                                                             
                                                            I am so freakin happy, and I am so glad I didn't send her a partial refund to quell the dispute. 
                                                             
                                                            first time in my life using quell, I hope I used it correctly
                                                             
                                                            I just had a rum and cream soda for the heck of it but now its effects along with these feelings of joy have combined into a mystical level of epicness I could not have prepared myself for.
